General Terms and Conditions

These General Terms and Conditions govern the sale of products displayed on the webshop www.rubiomonocoat.de, operated by Rubio Monocoat Deutschland GmbH.
By placing an order on our webshop, the customer accepts these Terms and Conditions in full. The online ordering process is legally binding.

Any natural person placing an order on the webshop outside their commercial, business, or professional activity is considered a โ€œCustomerโ€ under these Terms.

2. Scope of Application

These Terms apply to all offers made by the Seller, all orders placed by the Customer, and all contracts concluded between the Seller and the Customer through www.rubiomonocoat.de.
Any other terms are excluded unless expressly agreed in writing.

3. Ordering Process & Formation of the Sales Contract

The presentation of items does not constitute a binding offer. The Sales Contract is concluded when the Seller accepts the order by sending a written order confirmation. The customer is bound to their offer for two (2) weeks after submission.

The Seller reserves the right to refuse an order if:

  • (i) the Product is unavailable (the Customer will be informed immediately and refunded),
  • (ii) the delivery is not possible due to stock issues.

4. Prices

Prices shown in the online shop are gross prices in euros including statutory VAT. Rubio Monocoat Deutschland GmbH is not bound by material errors. Shipping costs are displayed in the order form before the customer submits the order.

All prices include German VAT. Shipping costs are subject to additional charges as stated in the shop.

5. Payment Methods

The purchase price and shipping costs are due for payment after conclusion of the contract. The customer can choose the payment method offered during the ordering process. The Seller will debit the account immediately after the contract is concluded.

6. Shipping

  • Products are delivered exclusively to countries within the European Union.
  • The delivery period is a maximum of 30 calendar days from receipt of payment, unless otherwise agreed.
  • The Seller is entitled to make partial deliveries, provided this is not unreasonable for the Customer.
  • If the customer is a consumer, the risk of loss or damage passes to the Customer upon delivery. In other cases, risk passes upon delivery to the carrier.

7. Right of Withdrawal

You have the right to withdraw from your purchase within 30 days of receiving your order. You do not need to give a reason.

To exercise your right of withdrawal, you must register your return online via your personal account. Please note that we don't accept return requests via email.

How to request a return:

  1. Log in to your account on our website.
  2. Navigate to "Orders" in your account menu.
  3. Select the order containing the items you wish to return.
  4. Click on "Request Return" and follow the prompts to complete your request.

Once your request is submitted, you will receive further instructions on how to ship the products back to us.

8. Warranty and Liability

The Seller is liable for material defects in accordance with statutory provisions. For consumers, the Seller is liable for intent and gross negligence. Liability for simple negligence is limited to foreseeable, contract-typical damages for essential contractual obligations (cardinal obligations).

9. Applicable Law & Dispute Resolution

All contracts are governed by German law. The European Commission provides an online dispute resolution (ODR) platform. The Seller is neither willing nor obligated to participate in dispute resolution proceedings before a consumer arbitration board.
